Privacy Notice

This Privacy Notice describes the information Verfico Software LLC (“Verfico”, “we”, “our”, or “us”) collects, how we use and retain this information, with whom we share it, and the choices you have in connection with these activities. This Privacy Notice applies to the Verfico’s website (https://www.verficopro.com/) (the “Website”) and our digital compliance platform, including our associated mobile application (“Mobile App”) and website application (“Web App”) (collectively, the “Platform”), owned and controlled by Verfico (collectively, our “Services”).

 

1. APPLICABILITY OF THIS PRIVACY NOTICE

The information that we collect and manage through the Website belongs to us and is used, disclosed, and protected according to this Privacy Policy.

 

Platform Used by Our Customers

 

We collect information through the Platform on behalf of our customers to provide our digital compliance services. Therefore, the information belongs to them, and how they use, disclose, and protect the information collected through the Platform is not subject to this Privacy Policy. However, we will disclose in this Privacy Policy what we collect about you on behalf of our customers.

 

We process our customers’ information as directed and in accordance with our agreements with our customers. Verfico acknowledges that you may have certain rights with respect to your personal information. With respect to the personal information collected or processed by the Platform on our customer’s behalf, our customers control and are responsible for responding to and complying with your privacy rights requests under applicable data protection laws.

 

If you use the Platform through one of our customers and would no longer like to be contacted by them or would like to exercise your privacy rights, please contact the customer that you interact with directly.

 

2. PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, HOW LONG WE KEEP IT, AND HOW WE SHARE IT

 

When you interact with our Services, we collect your personal information. Personal information is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.

 

A. When you engage in our Platform through our customer

 

When we collect your personal information through the Platform we are collecting your personal information on behalf of our customer, and if applicable, we are processing your personal information in accordance with the data processing agreement in place with our customer. If you seek to submit a privacy rights request related to the personal information collected in this section, we will provide your request to our customer (or the ultimate data controller), or you can contact them directly. In certain instances, however, circumstances may necessitate Verfico to assist our customer with your request or inquiry.

 

We will collect your personal information when you:

 

  • Register for the Mobile App. When you register and set up your Mobile App account, we will collect your identifiers (name, telephone number, selected password, email address (if you wish to provide it), employment information (employer name, job site address, any certifications you have attained (safety-related, construction-related, etc.), and job title (if you wish to provide it)), protected classification (race, ethnicity) if you elect to provide it, a picture of your face, geolocation (with your consent through your mobile device), and only the last four digits of your social security number. We will use your identifiers to set up your account profile, and we will use your telephone number to send you a verification code as part of the account verification process. We will use the last four digits to match your profile to the information provided by your employer for payroll reconciliation. We will use your geolocation information to determine whether you are on the job site to which you are assigned and to locate you in the event of an emergency. With your consent through your mobile device, we will also access your camera so you can scan a QR code to clock in and clock out of the job site. We will share this information with your employer to provide our services in accordance with the agreement we have with your employer. We will also share your identifiers and geolocation with other parties responsible for your safety and work at the job site.

  • Register for the Web App. When you register for an account on the Web App we will collect your identifiers (name, telephone number, selected username and password, email address (if you wish to provide it), employment information (employer name, job site address, and job title/role (if you wish to provide it)), and a picture of your face. We will use your identifiers to set up your account profile, and we will use your telephone number to send you a verification code as part of the account verification process. We will share this information with your employer to provide our services in accordance with the agreement we have with your employer.

  • Log in to the Platform. When you log in to the Platform, we will collect your personal identifiers (username and password). We will use this information to authenticate you to your account.

  • Use the Mobile App. When you use the Mobile App, we will use your geolocation information to determine whether you are on the job site to which you are assigned and to locate you in the event of an emergency. With your consent through your mobile device, we will also access your camera so you can scan a QR code to clock in and clock out of the job site. We will share this information with your employer to provide our services in accordance with the agreement we have with your employer. We will also share your identifiers and geolocation with other parties responsible for your safety and work at the job site.

  • Automatic Data Collection. In addition to the personal information identified above, when you use the Mobile App, we and our third-party provider collects your internet and other electronic network activity (IP Address, operating system, and device type) via SDKs to make the Mobile App work as you expect it to and to provide enhanced functionality as described below.  Some of the SDKs we use will store and retrieve information on your device, like a cookie or other similar tracker would. 

    • Essential SDKs.  We use essential SDKs which are necessary for the Mobile App to function. If you do not provide this information, we would not be able to provide the Mobile App.

    • Performance SDKs.  When you use the Mobile App, we automatically collect, through our third party SDK provider, your internet and other electronic network activity (IP Address, operating system, and device type) regarding your device and use of the Mobile App. Verfico uses the information to test the performance of and improve the Mobile App for all users.  This information is shared with our third party SDK provider on an aggregated and anonymized basis.

  • Aggregate data. We aggregate the data we collect for benchmarking purposes and for internal analytics.

 

B. When you interact with our Website, we collect your personal information when you:

 

  • Automatic Data Collection. We collect information automatically as you use our Website. This includes the following internet or other electronic network activity information:

 

  • Usage information. We use essential, performance, and analytics cookies to collect information about your interaction with our Services, such as what you access, what you click on, the frequency of access, and how much time you spend on the Services. 

 

  • Device information. We use essential, performance, and analytics cookies to collect certain information about the device you use to access the Services, such as browser type, browser language, hardware model, operating system, and device preferences.

 

  • Location information. We use essential, performance, and analytics cookies to collect information about your location, which may be determined through your IP address, GPS, or RFID signal.

 

  • We use this information to: (i) track you within the Services; (ii) enhance user experience; (iii) conduct analytics to improve the Services; (iv) prevent fraudulent use of the Services; (v) diagnosis and repair Services errors, and, in cases of abuse, track and mitigate the abuse.

 

Particular third-party cookies to note on our Website include:

 

  • Google Analytics. We use Google Analytics to collect information on your use of our Website to improve our Website. In order to collect this information, Google Analytics may set cookies on your browser, or read cookies that are already there. Google Analytics may also receive information about you from applications you have downloaded that partner with Google. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Google’s ability to use and share information collected by Google Analytics about your visits to our Website is restricted by the Google Analytics Terms of Use and Privacy Policy.  To prevent your data from being used by Google Analytics, you can download the Google Analytics opt-out browser add-on.

 

In general, to disable cookies and limit the collection and use of information through them, you can set your browser to refuse cookies or indicate when a cookie is being sent. When you opt-out an opt-out cookie will be placed on your device. The opt-out cookie is browser and device specific and will only last until cookies are cleared from your browser or device.

 

3. HOW WE SHARE YOUR PERSONAL INFORMATION

 

Verfico shares personal information in the following instances:

 

  • Within Verfico. We share your personal information within Verfico for the legitimate business purposes of efficiently and effectively providing the Services, such as accounting and customer service support. Access to your personal information is limited to those on a need-to-know basis.

 

  • With service providers. We share personal information with service providers that assist us in providing the Services. These service providers are described more specifically in the PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, HOW LONG WE KEEP IT, AND HOW WE SHARE IT section of this Notice. Generally, we share the information described above with our cloud data storage and infrastructure provider, and your identifiers with our customer relationship management provider.

 

  • In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We would also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

 

  • For legal purposes. We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

 

  • With our Customer: We will share your personal information with our customer(s) associate with the job site to which you are assigned. We share this information to provide the Platform through our customer to you. We will make your personal information available to our customer in accordance with the agreement and data processing agreement with our customer (as applicable). When requested, we will also share or facilitate the sharing of your personal information with third parties pursuant to instructions from our customer, such as any third party providers integrated into the Platform, or as required by law.

 

  • With your consent: Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time.

 

Verfico may also share anonymized and aggregated data (“De-Identified Information”) in marketing materials. Verfico may also use De-Identified Information for commercial collaborations with private companies for purposes such market analysis.

 

4. GENERAL INFORMATION CHOICES

 

You have the following choices with respect to your personal information:

 

  • Correct or view your personal information. You may access your Verfico account profile to correct or view certain personal information of yours in our possession and which is associated with your profile.

 

  • Location settings. You can prevent your mobile device from sharing your location data by adjusting the permissions on your mobile device or within the Services.

 

  • Push notifications. If you have enabled push notifications, you may disable these at any time by updating your device settings.

 

  • Uninstall the Mobile App. You can stop further collection of your personal information through the Mobile Application by uninstalling the Mobile Application.

 

  • Opt Out of Other Cookies.  All session cookies are temporary and expire after you close your web browser. Persistent cookies can be removed by following your web browser’s directions. To find out how to see what cookies have been set on your computer or device, and how to reject and delete the cookies, please visit: https://www.aboutcookies.org/. Please note that each web browser is different. To find information relating to your browser, visit the browser developer’s Website and mobile application. If you reset your web browser to refuse all cookies or to indicate when a cookie is being sent, some features of our website may not function properly. If you choose to opt out, we will place an "opt-out cookie" on your device. The "opt-out cookie" is browser specific and device specific and only lasts until cookies are cleared from your browser or device. The opt-out cookie will not work for essential cookies. If the cookie is removed or deleted, if you upgrade your browser or if you visit us from a different computer, you will need to return and update your preferences. By clicking on the “Opt-Out” links below, you will be directed to the respective third-party website where your computer will be scanned to determine who maintains cookies on you. At that time, you can either choose to opt out of all targeted advertising or you can choose to opt out of targeted advertising by selecting individual companies who maintain a cookie on your machine.

 

5. RIGHTS OF NEVADA RESIDENTS

 

If you are a consumer in the State of Nevada, you may request to opt-out of the current or future sale of your personal information. We do not currently sell any of your personal information under Nevada law, nor do we plan to do so in the future. However, you can submit a request to opt-out of future sales by contacting us at contact@verficopro.com. Please include “Opt-Out Request Under Nevada Law” in the subject line of your message.

 

6. DO NOT TRACK

 

We do not recognize “Do Not Track” requests for internet browsers. Do Not Track is a preference you can set to inform websites and applications that you do not want to be tracked.

 

7. SECURITY OF YOUR PERSONAL INFORMATION

 

We implement and maintain reasonable security measures to protect the personal information we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. These security measures include encryption and access controls. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the personal information we have collected from you.

 

8. SUBCONTRACTOR INFORMATION

 

Verfico has implemented, and will continue to maintain, reasonable security measures and policies to keep subcontractor’s payroll information private. Subcontractor[1]  payroll information is only shared with Verfico’s customer in response to legal process or to conduct an audit in accordance with Customer’s contract with subcontractor.

 

9. AGE RESTRICTION

 

The Services are not intended for individuals under the age of sixteen (16). If we learn that we have collected or received personal information from a child under the age of sixteen (16), we will delete that information. If you believe we might have information from or about a child under the age of sixteen (16), please contact us at contact@verficopro.com.

 

10. CHANGES TO THIS PRIVACY NOTICE

 

We may amend this Privacy Notice in our sole discretion at any time. If we do, we will post the changes to this page, and will indicate the date the changes go into effect. We encourage you to review our Privacy Notice to stay informed. If we make changes that materially affect your privacy rights, we will notify you by prominent posting on the Website and/or via email, and request your consent, if required.
